TERMS AND CONDITIONS 

All bookings are made with JLMA GROUP P/L (ABN 9660 8606 284) trading as North East Regional Tours (us/we).

By booking a trip with us you are deemed to have agreed to these Booking Conditions (which constitutes the entire agreement between you and us) and your booking will be accepted by us on this basis.

The services to be provided are those referred to in your booking confirmation/tax invoice.

PAYMENTS / SECURING A BOOKING

Bookings will only be confirmed once full payment is received.
Full payment of any booking must be received prior to travel commencing with North East Regional Tours.

All bookings & payments must be secured via North East Regional Tours website booking system by way of valid credit card, which will then be held until completion of the booking as security.

If any payment is made by way of a third party, valid personal photo identification must also be held as security until completion of your booking.

All secured bookings will be issued a tax invoice/receipt which must be presented at the time of boarding as proof of purchase along with valid photo identification.

We reserve the right to cancel any tentative booking if payment is not made in full prior to travel.

We reserve the right to refuse tour bus entry to any person without a valid tax invoice/receipt.

TRANSFER OF BOOKINGS

Any booking transfer will be at the discretion of management.

CREDIT CARD SECURITY

In confirming your booking with us, credit card security will be required. Our vehicles cannot be booked without valid credit card details being provided by the hirer and held until conclusion of the booking. Extra charges will apply in the event of damage occurring to the tour bus and any of its contents by any person/s.

If damage does occur to the tour bus, restricting the bus to be returned for passenger drop-off at the designated time of tour completion, extra charges will be applied for any costs incurred following this time. These costs include but are not limited to the Driver’s time, the return transport of fellow passengers to their designated drop-off locations & delays in proceeding to the vehicle’s next booking.

If there are delays due to waiting on passengers outside of the designated time at each stop stated by the Driver, extra charges will also apply.

All extra time charges will be at a rate of $50.00 per 15 minutes.
If the tour bus is waiting for any passenger any longer than 15 minutes, which in turn delays the tour, we reserve the right to continue the tour without them & they must arrange alternative transport at no further cost to us.

TYPE OF BOOKING

Your type of booking, along with any inclusions, will be documented by us and sent to you via email along with your tax invoice/receipt, upon full payment of the booking.

In all cases where extra time on the job and/or extra travel is required to complete the job outside of agreed/documented details, extra charges will apply.

We reserve the right to amend or make changes to the tour itinerary at any time & within short notice if necessary. While we endeavour to operate all tours as described, we reserve the right to change the tour itinerary for benefit of the tour/group. Examples include but are not limited to venue open/close time changes, venue change of management/operating standards, venue closure due to staff illness or venue renovation.

We reserve the right to change an itinerary after departure due to local circumstances or events outside of our control.

Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itinerary.

Unless tour times are adjusted at the discretion of management or by our Driver due to unforeseen circumstances or circumstances out of our control, all tour arrangements will remain the same.

CANCELLATIONS / REFUNDS

If you cancel some or all portions of your booking, cancellation fees will apply. A cancellation will only be effective when we receive written confirmation of the cancellation. If you cancel a trip:

– NO REFUND will be provided for any booking/payment made within 14 days prior to the booking date.

– 50% REFUND will be provided for any booking/payment made between 15 and 29 days prior to the booking date.

– A FULL REFUND will be provided outside of 30 days prior to the booking date.

If you leave a trip for any reason after commencement, no refunds will be given for any unused services.

If you fail to join a tour, join it after departure, or leave it prior to its completion, no refund will be given.

Any alternative transport &/or expenses made if you leave the tour for any reason at any time are at no further cost to us. Examples include but are not limited to public transport, private transport, ambulance/hospital visit or any other medical expenses incurred.

CANCELLATION BY US

We must have a minimum group of 6 passengers for any tour to go ahead.
We may cancel a tour at any time prior to departure if we do not reach a minimum amount of 6 fully paid passengers.

A tour may also be cancelled at any time prior to the tour or during the tour if conditions are dangerous or placing passengers at risk. Examples may include but are not limited to terrorism, natural disasters, very poor weather, vehicle mechanical failure or other external events in which it is not viable for us to operate the planned itinerary.

If we cancel your trip, you can transfer amounts paid to an alternate departure date or receive a full refund.  In circumstances where the cancellation is due to external events outside our reasonable control, refunds will be less any unrecoverable costs.  We are not responsible for any incidental expenses that you may have incurred as a result of your booking.

CANCELLATION BY DRIVER

The driver reserves the right to terminate any booking at any time during the hire period, if any of the following occur:

Excessive drinking behaviour Drug Use Violence or abusive behaviour Underage drinking Vehicle damage Behaviour causing major cleaning Smoking Driver at risk.

A demand to the Driver to operate the vehicle illegally will result in immediate termination of the hire. Any passenger involved in the above activities will be asked to leave the tour/tour bus immediately with no refund given.

CUSTOMER REFUSAL TO FOLLOW DRIVER INSTRUCTIONS

Where passengers refuse to follow reasonable instructions given by the Driver, the Driver will stop the vehicle immediately and terminate hire. No refund will be given and all passengers involved will be required to leave the vehicle immediately.

VEHICLE CAPACITY

The number of passengers is not to exceed the maximum number as specified for the vehicle under the Australian Design Rules.

HIRE OVERRUN / EXTRA TIME / WAITING TIME

In all cases where extra time on the job and/or extra travel is required to complete the job outside of agreed/documented details, extra charges apply of $50.00 for every 15 minutes & thereafter.

We reserve the right to terminate any booking where the delay in picking up/starting the job results in the time extension required to complete the job affecting our ability to provide service for a later booking.

REQUESTING CHANGES TO A BOOKING

All requests for changes to an original booking will be at the discretion of Management. Changes may or may not be allowed. The person making the original booking will be notified of any extra charges to be made in full prior to start of booking time.

Making a verbal arrangement with a driver to alter a booking is not allowed.

CHILDREN/SUPERVISION OF MINORS

Children under the age of 7 are not permitted on our bus tours.

Where passengers are under the age of 18, an adult/parent/guardian must be present to provide adequate supervision at all times throughout the booking.
We take no responsibility of any instance held outside of the tour bus, whether it be at a venue or a break stop such as public toilets, food outlets etc.

All passengers are to enter public spaces & establishments at their own risk.

It is the hirer’s responsibility to notify us of any intention to transport children in our vehicles at the time of making a booking.

DAMAGE TO VEHICLES

By entering the tour bus vehicle provided by us, the hirer accepts that the vehicle is undamaged and that they will be held solely responsible for any damage that occurs during the hire period that is caused by the themselves or their own actions.

Damage to vehicles as a result of neglect or mistreatment by passengers will be directly charged to the offending passengers credit card. This includes any damages such as, but not limited to, marks/burns/tears in/on upholstery or fittings, spillages, theft or abuse to the vehicle either inside or out.

FOOD AND DRINK IN VEHICLES

Food &/or alcohol consumption is not permitted in the tour bus at any time, unless otherwise authorised to do so by Management. Take away food is not allowed in the vehicle. At all times, Management reserves the right to restrict the quantity and type of alcohol or food consumed in the vehicle.

CLEANING FEES

A cleaning fee of $300.00 is payable immediately by the hirer, if any person/group causes a vehicle to become so soiled as to require major cleaning before the vehicle can proceed to its next booking. If the vehicle is delayed in taking its next booking as a consequence, the hirer will be charged standard hourly rates until the vehicle can resume normal work activities, plus any and all other charges which may apply as a consequence.

OFF-ROAD SERVICE

Vehicles are not intended or engineered for off road use. We will not use our vehicles on unmade roads. We reserve the right to refuse to take the vehicles off hard, dry, sealed/bitumen surfaces.

POSSESSIONS LEFT IN VEHICLES

Any possessions left in the tour bus at the conclusion of the tour will be available for collection by arrangement.

DELAYS IN SERVICE

We do not charge for delays due to road works or bad weather/driving conditions. We will not be held responsible for delays in delivery of booked services due to unforeseen events such as, unsafe driving conditions caused by the weather, poor or dangerous road conditions/road works, traffic congestion or vehicle mechanical breakdown.

Examples include but are not limited to late flights, late lunch/dinner booking arrivals, requesting journey stops for food/drink/ill passengers, delayed departure from a pick up point due to late passenger/s.

Where delays are caused by the hirer/passenger requests and service has to be provided by us to complete a booking outside the original service agreement, such as requesting journey stops for toilet/food/drink/ill passengers, charges will be applied at our standard hourly rate.

MECHANICAL/ACCIDENT DAMAGE

All of our vehicles are regularly checked and serviced to the required standards. In the event that the tour bus is involved in an accident or experiences a mechanical failure prior to the commencement of a tour, we will make arrangements, wherever and however possible, to provide service for the hirer. In some cases, this may not be possible & a tour may have to be cancelled.

We will not be held liable in the event of mechanical breakdown or an accident which causes delays in or cancellation of the service being provided to a hirer.

APPLICABLE LAW

The laws of Victoria, Australia govern these Booking Conditions to the fullest extent allowable.  Any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of Victoria, Australia.
